City of Albuquerque Ballot Initiative on Mandatory Sick Leave Update: There was a great response from NMBC members and pro-business community advocates who attended the Bernalillo County Commission meeting last Thursday. An NMBC spokesperson, our members and many others from the community who are business owners spoke against putting the Albuquerque ballot initiative concerning mandatory sick leave on the November 8 ballot.

The good news is a majority of the County Commission listened and voted against putting the issue on the November ballot. The bad news is advocates for the mandatory sick leave ordinance immediately went to court and obtained a temporary restraining order, barring the Bernalillo County Clerk from preparing the November 8 ballot without at least a summary of the sick leave ordinance on the ballot. A hearing on this matter was held yesterday and NMBC, along with our members was in there (in the courtroom) until 7 pm last night. After three hours of attorneys from both sides presenting background, established law, contested and uncontested matters of fact about why the Albuquerque Mandatory Sick Leave Ordinance should, or should not be placed on the November 8 ballot, and if so whether it should be the full text or a summary of the ordinance, the judge asked for final arguments before he made his decision.

Final arguments were made, the judge took at short break and then came back with two decisions: 1) The Sick Leave Ordinance will not be placed on the November 8 ballot; and 2) The Sick Leave Ordinance must be placed on the 2017 City of Albuquerque municipal election in it’s entirity, as it was originally submitted as a ballot initiatiave. NMBC is glad to have part of a coalition of pro-business advocates who came together against this ordinance. We will be involved in educating voters about the number of jobs that will be lost if this ordinance does pass and efforts to change the process that allows anti-business groups to use a ‘petition drive’ to further their agenda.
