Hold Harmless? Voters Will Have the Last Say

NMBC Working Well with Others: Carla Sonntag, NMBC President, spoke recently to a group of executives representing Chambers of Commerce from around the state. The message: “New Mexico will do better when we are all working together to assure we have pro-business elected officials serving the state.” NMBC is currently working with Chamber executives in Las Cruces and Farmington and would like to work with others as well.

Say what? Bernalillo County Commissioners are currently considering a franchise fee to be levied against utility companies that is not allowed by NM statute. It would be illegal!

But that’s not the best part. Section 12 of the new ordinance states in part, “ . . . In the event the right-of-way use fee, . . . is declared illegal, unconstitutional or void for any reason . . . the company shall be contractually bound to pay the County, at the same rate …, an aggregate amount equal to the amount that would have been paid . . .”

Commission Chair, Maggie Hart-Stebbins, Vice Chair Debbie O’Malley and Commissioner Art de la Cruz voted to consider the ordinance at a future meeting. Commissioners Wayne Johnson and Lonnie Talbert voted against it.
