New Oil and Gas Rules Add Major Costs for Producers
The New Mexico Oil Conservation Commission has finalized new rules that dramatically increase financial assurance requirements for certain oil and gas wells.
The new rules require $150,000 in financial assurance for wells the state considers high risk, including aging, low-producing, or inactive wells. The previous minimum was $10,000.
That is a 1,400% increase.
Supporters say the rule is intended to ensure wells are properly plugged and cleaned up. The concern is that this new mandate creates a high fixed cost that will fall hardest on small and independent producers.
For smaller companies, a jump from $10,000 to $150,000 per well can tie up capital, limit investment, make transfers more difficult, and force the premature plugging of wells that may still have productive life left.

The latest jobs numbers point to an encouraging trend: private-sector job growth continues to drive the economy. The graph above shows private-sector employment up by 717,000 jobs from January 2025 through April 2026, while federal government employment declined by 345,000 jobs. Businesses generate the revenue that supports families, local economies, and public services. That is especially important for New Mexico, where government spending and public-sector employment play an outsized role in the economy. DOJ Lawsuit Adds More Uncertainty for Businesses
The U.S. Department of Justice has filed a lawsuit against the State of New Mexico and the City of Albuquerque over policies federal officials argue obstruct immigration enforcement efforts.
At the center of the dispute is Albuquerque City Ordinance O-26-15, known as the “Safer Community Places Ordinance” (SCPO). Since its passage, many business owners have raised concerns about both the practical costs of compliance and the uncertainty surrounding how the ordinance will ultimately be enforced.

The lawsuit challenges both New Mexico’s Immigrant Safety Act and Albuquerque’s “Safer Community Places Ordinance.” According to the DOJ, these policies restrict cooperation between local governments and federal immigration authorities and limit the use of government property for enforcement activity.
